Tucked inside ObamaCare is the individual mandate. The individual mandate requires that every person living in America, legal or illegal, purchase some form of healthcare insurance. The government will require this so that they can claim that every person in America has insurance. This past week, a pundit representing the left commented that the disciplinary actions applied to anyone not participating in the individual mandate were incentives. I about choked on my Corn Flakes. Fining individuals between $1900 and $3800 or throwing them in jail and fining them an additional $25,000 for not paying the aforementioned fine should be considered incentives? This is the maddening lunacy of those on the left. Punishing people for not participating in government mandated insurance is not incentivizing. That would actually be government activity representing a tilt towards Totalitarianism.
The Congressional Budget Office has this to say about the individual mandate, “A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States.” Even car insurance does not carry this same unprecedented requirement because we can choose whether to own and operate a vehicle or not. ObamaCare, even without the public option, is an unconstitutional government takeover.
The Wall Street Journal reports:
Under questioning last week, Tom Barthold, the chief of staff of the Joint Committee on Taxation, admitted that the individual mandate would become a part of the Internal Revenue Code and that failing to comply “could be criminal, yes, if it were considered an attempt to defraud.” Mr. Barthold noted in a follow-up letter that the willful failure to file would be a simple misdemeanor, punishable by the $25,000 fine or jail time under Section 7203. So failure to pay the mandate would be enforced like tax evasion, but Mr. Obama still claims it isn’t a tax. “You can’t just make up that language and decide that that’s called a tax increase,” Mr. Obama insisted last week to ABC interviewer George Stephanopoulos. Accusing critics of dishonesty is becoming this President’s default argument, but is Mr. Barthold also part of the plot?
